Delaware Township Planning Commission

The purpose of the Delaware Township Planning Commission is to promote good planning practices in accordance with the provisions of the Pennsylvania Municipalities Planning Code (see below).

Pennsylvania Municipalities Planning Code

- Prepare the Comprehensive Plan for the development of the municipality as set forth in the Pennsylvania Municipalities Planning Code, and present it for the consideration of the governing body.

- Maintain and keep on file records of its action. All records and files of the planning agency shall be in the possession of the governing body.

At the request of the governing body, the Planning Commission may:

  • Make recommendations to the governing body concerning the adoption or amendment of an official map.
  • Prepare and present to the governing body of the municipality a zoning ordinance, and make recommendations to the governing body on proposed amendments to it as set forth in the Pennsylvania Municipalities Planning Code.
  • Prepare, recommend and administer subdivision and land development and planned residential development regulations, as set forth in the Pennsylvania Municipalities Planning Code (Subdivision & Land Development Ordinance).
  • Prepare and present to the governing body of the municipality a building code and a housing code, and make recommendations concerning proposed amendments thereto.
  • Do such other acts or make such studies as may be necessary to fulfill the duties and obligations imposed by the Pennsylvania Municipalities Planning Code.
  • Prepare and present to the governing body of the municipality an environmental study.
  • Submit to the governing body of a municipality a recommended capital improvements program.
  • Prepare and present to the governing body of the municipality a water survey, which shall be consistent with the State Water Plan and any applicable water resources plan adopted by a river basin commission. The water survey shall be conducted in consultation with any public water supplier in the area to be surveyed.
  • Promote public interest in, and understanding of, the comprehensive plan and planning.
  • Make recommendations to governmental, civic and private agencies and individuals as to the effectiveness of the proposals of such agencies and individuals.
  • Hold public hearings and meetings.
  • Present testimony before any board.
  • Require from other departments and agencies of the municipality such available information as relates to the work of the planning agency.
  • In the performance of its functions, enter upon any land to make examinations and surveys with the consent of the owner.
  • Prepare and present to the governing body of the municipality a study regarding the feasibility and practicability of using renewable energy sources in specific areas within the municipality.
  • Review the zoning ordinance, subdivision and land development ordinance, official map, provisions for planned residential development, and such other ordinances and regulations governing the development of land no less frequently than it reviews the comprehensive plan.
Delaware Township Subdivisions and Lot Improvements

At a minimum, the application for approval of Lot Improvements and Subdivisions under the provisions of Section 107.6.D of the Subdivision and Land Development Ordinance, must be submitted on a properly executed plan with ten (10) copies including:

  1. All lots involved in the lot improvement, drawn to scale, with dimensions and acreage for each lot, both before and after the proposed changes. 107.6.A.2
  2. Identification of all lots as they exist prior to any proposed changes (ex lot 1, lot 2).
  3. Identification of all lots as they will result from the proposed changes (ex lot 1A, lot 2A).
  4. Dotted lines where existing lot lines are to be eliminated. 107.6.D.2.c
  5. All existing improvements, including but not limited to buildings, structures, roads, driveways, walls, outbuildings, ancillary structures, wells, and sewage or septic systems shall be shown. If there are no improvements, the parcel(s) shall be labeled "UNIMPROVED". 107.6.D.2.d
  6. A statement that all resulting parcels may not be further subdivided without Township approval, and all such parcels must be specifically identified by the numbers or other symbols shown on the drawing. This requirement applies regardless of the size of the parcel. 107.6.D.2.e
  7. A statement that any parcels resulting from the lot improvement, including any remaining lands, comply in all respects with the provisions of the Subdivision and Land Development Ordinance. 107.6.D.2.f
  8. Signature blocks for both the Planning Commission and the Board of Supervisors. 107.6.D.2.g
  9. Identification and address of the property owner, the date of submission, and sufficient information to locate the parcel accurately. 107.6.D.2.h
  10. Name, license number, seal and signature of the PA registered/certified surveyor or engineer who prepared the plan. 107.6.D.2.i
  11. The Applicant shall submit an origional and one (1) copy of the deed describing the newly combined lots, which shall be fully executed in recordable form, showing metes and bounds. In addition, the Applicant shall submit for review, copies of the existing recorded deeds to verify ownership of the property being combined. 107.6.D.3
  12. The Applicant shall show the names of all adjoining lot owners with deed book and page number of each. 107.6.B.6
  13. North Arrow, indicating whether the meridian is magnetic or true, year of meridian must be shown. 107.6.B.19
  14. A letter from Pike County Planning with their comments. 107.4.C.1

In addition to these minimal requirements, the Township may require such additional information as it deems necessary to insure that all requirements of the Subdivision and Land Development Ordinance have been complied with.

A fee of $50.00 must be paid at the time the plan is submitted. Additionally, a zoning application must accompany the planning application. 107.5

The plans must be submitted to the Planning Commission Secretary the Friday before the Planning Commission's Regular Meeting at the Township Municipal Building, Wilson Hill Road, Dingmans Ferry, PA 18328. 107.4.A

NOTE: The Planning Commission's Regular Meetings are held on the first Wednesday of the month at 7:30PM and the third Tuesday of the month at 7:30PM. Workshops are held the fourth Monday of the month at 6:30PM.
