All persons making an appeal for a variance or code interpretation of the Zoning or
Building Code should be prepared to present their case in a clear and concise manner.
Present drawings, photos, manufacturer’s details and instructions, installation
drawings, and any other detail that will aid the Appeals Board to understand your
request and make a knowledgeable decision.
The Board’s decision is based only upon the evidence presented for this case, and
is not bound by any past decisions. Each case is decided on its own merits.
Be aware that the Appeals Board can grant a request based on code interpretation or
unnecessary hardship. Your case should be prepared accordingly.
The Appeals Board will not make a code interpretation for general use of the Building or
Zoning Codes. An interpretation will apply only to the specific case before them. An
appeal, if based on unnecessary hardship, should include the presentation of evidence
supporting the cost of compliance with the Code.
Be prepared to discuss alternate solutions or equivalencies that would provide for the
health and safety of the public.
Fees: $600 for Variance and Hearing.
